Legislative Counsel Testifies that Governor’s Redevelopment Proposal Legally “Problematic” Because of Prop. 22
Sacramento In testimony before the Senate and Assembly Budget Conference Committee today, a representative from the Office of Legislative Counsel indicated the Governor’s proposal to abolish redevelopment is legally “problematic.”
When asked by Assembly Member Felipe Fuentes to opine on the legality of the Administration’s proposal, the lawyer from the Office of Legislative Counsel responded:
“Prop. 22 specifically prohibits the Legislature from, um, enacting a statute that requires an (redevelopment) agency to transfer tax increment money for the benefit of the State or agency of the State or any jurisdiction. So, that, on the face of it could may be problematic.”
This testimony underscores what the broad coalition of cities, businesses, labor, affordable housing advocates and community leaders has been saying all along: the Governor’s redevelopment proposal is unconstitutional and violates Prop. 22, which passed overwhelmingly by 61% of California voters less than four months ago.
